This is your occasional reminder that publishers were already preparing their lawsuit against the Internet Archive in 2019, before the pandemic, and before the archive relaxed their lending restrictions.
The Internet Archive is a target merely for existing. The nature of the IA is to be a challenge to the ownership of information as capital. There is nothing they could do to mollify publishers.

Their argument for fair use was much higher before they made a supremely stupid decision, but it was still a high bar to clear, as is the nature of a fair use defense.

Well said. It's almost like our copyright system is broken and stifles the very innovation it was meant to protect, and the attacks on IA are just bog-standard rentier behaviour.
